Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of SitePin — the web dashboard, public share pages, and the SitePin Chrome extension (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

SitePin lets you annotate websites with positioned comments ("pins"), collect feedback from collaborators and share-link visitors, capture screenshots and page metadata, and run AI-assisted UX analysis. The Service is provided on an as-available basis and its features may change over time.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for safeguarding your credentials and for all activity that occurs under your account.
• You must notify us promptly of any unauthorized use of your account.

4. Acceptable use

You agree not to:

• Use the Service to annotate, capture, or store content you do not have the right to access;
• Upload content that is unlawful, infringing, malicious, or that contains other people's personal data without a lawful basis;
• Probe, scan, overload, or disrupt the Service, or attempt to bypass rate limits, share-link passwords, or other access controls;
• Resell or provide the Service to third parties except through the collaboration features we provide;
• Use the Service to develop a competing product.

5. Your content

You retain ownership of the comments, screenshots, and other content you submit. You grant us a limited license to host, process, display, and transmit that content solely to operate and improve the Service. You are responsible for the content you and your invited collaborators submit, and for ensuring you have the right to annotate the websites you use the Service on.

6. Share links

Projects can be shared via tokenized links, optionally protected by a password and scoped permissions. Anyone you give a share link (and, where enabled, its password) to can access the associated project content according to the permissions you configured. You are responsible for who you share links with.

7. AI features

AI-generated output (UX findings, suggestions, summaries, rewrites) is produced by machine-learning models and may be inaccurate or incomplete. It is provided for informational purposes only and you are responsible for reviewing it before acting on it. We may set usage limits on AI features.

8. Third-party websites

The Service renders and annotates third-party websites you choose. Those websites are not part of the Service, and their content remains subject to their own terms. We are not responsible for third-party websites.

9. Privacy

Our Privacy Policy explains what data we collect and how we use it, and forms part of these Terms.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms or if we discontinue the Service. Upon termination we may delete your content after a reasonable period.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NEVER BE LOST — KEEP BACKUPS OF ANYTHING CRITICAL.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$50 OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will give notice through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
